Terms of Service
These terms govern your use of Athenion. Please read them. The Spanish version is the legally binding one: if the two versions differ, the Spanish version prevails, because the operator is based in Peru.
1. Who we are
Athenion is operated by:
- Name: Leonardo Jesus Ferreyra Canaval
- ID: RUC (Peruvian taxpayer number) 10728483844
- Address: Av. Colombia 930, Pueblo Libre, Lima, Perú
- Support: [email protected]
The operator is an individual (persona natural) in Peru. "We" and "us" mean the operator. "You" means the person using Athenion. Our handling of personal data is described in the Privacy Policy.
2. Acceptance and eligibility
By creating an account or using Athenion at https://athenionlearn.app, you accept these terms. If you do not accept them, do not use the service.
- You must be 18 or older.
- You can sign in with Google, Microsoft, or a 6-digit code sent to your email. Keep your access secure. You are responsible for activity under your account.
- Accounts are individual. Do not share your account.
For now we offer individual accounts only. Institutional or school plans may come later, under separate agreements.
3. The service and beta status
Athenion is an AI tutor. It teaches you a topic step by step, keeps your notes and progress, schedules reviews, and offers practice workspaces and portfolio projects.
Access is currently invite-only (beta). During the beta:
- features may change, break or be removed;
- there is no service level agreement (no guaranteed uptime);
- we may reset or limit access when needed to keep the service running.
We will do our reasonable best to keep your data safe, and you can export your notes at any time (section 9).
4. AI limitations
Athenion's lessons, answers and feedback are generated by AI.
- It can be wrong. It may state false things confidently, or be out of date. Check important facts with reliable sources.
- It is not professional advice. Nothing in Athenion is medical, legal, financial, or other professional advice.
- You stay responsible. You decide how to use what you learn. Do not rely on Athenion for decisions where an error could cause harm.
- Athenion does not make decisions with legal or similarly significant effects on you. A human can review any concern you send to [email protected].
Your text is sent to a third-party AI provider to generate responses, as described in the Privacy Policy.
5. Acceptable use
Do not:
- break the law or upload illegal content;
- attack, probe or overload the service or other systems;
- scrape or copy the service in bulk, or use it to build a competing product;
- circumvent usage limits, access controls or the invite system;
- mine cryptocurrency or run unrelated heavy workloads in practice workspaces;
- use practice workspaces to attack third parties or host illegal content;
- connect real cloud accounts or enter real cloud credentials or payment methods in practice workspaces. Athenion practice workspaces use free local emulators only. You never need to pay a cloud provider to learn here;
- impersonate others or abuse other people's data.
We may remove content or suspend access for violations (section 12).
6. Fair-use limits
To keep the service sustainable, each account has a monthly allowance of AI use. It is measured as AI tokens, and we do not reduce it unpredictably. If you reach it, we may slow or pause AI features until the next period, and we will tell you in the app. The allowance for your plan will be shown before you subscribe.
7. Subscription, free trial and payments (future)
Paid plans are not available yet. The following will apply when they start.
Price. A monthly subscription at a price that will be announced before payments start. The price will be shown before any charge. Spanish-speaking users see the price in USD, with a soles equivalent shown as approximate. The final amount charged is the one shown at checkout.
Free trial. New subscribers get a 1-month free trial. A payment card is required to start it. You are not charged during the trial. If you cancel before the trial ends, you will not be charged. If you do not cancel, the subscription starts and renews monthly until you cancel. We will show the date of the first charge before you start.
Payment provider. Payments are processed by our payment provider (merchant of record), which will be named here before payments start. It is the seller of record for the transaction. Its own terms and refund policy apply to the transaction. We never see your full card number.
Renewal reminders. We will remind you before the first charge and before price changes.
Cancellation. You can cancel at any time, from your account settings or by emailing [email protected]. Cancelling is as easy as signing up. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Refunds. The refund policy of our payment provider applies to each transaction. We will also review in good faith any request sent to [email protected], and nothing here limits your mandatory consumer rights.
Price changes. If the price changes, we will notify you before your next charge, and you can cancel before it applies.
8. Complaints: Libro de Reclamaciones
You can file a complaint in our virtual Libro de Reclamaciones: it will be available here before payments start. A link is also available on the site and in your account. You can also write to [email protected], and you may go to Indecopi at any time.
9. Your content
You own it. You own your notes, your inputs, your chat messages, and the code you write in practice workspaces ("your content"). That includes the words you write in your own words.
Our license. You give us a limited, non-exclusive license to host, process and display your content only as needed to operate the service for you, including sending it to our processors listed in the Privacy Policy. The license ends when you delete the content or your account, subject to the retention periods in the Privacy Policy.
No AI training. We do not use your content to train AI models.
Export and deletion. You can export your notes as Markdown (an Obsidian vault) anytime from the app. You can delete your account anytime. We delete your data within 30 days after deletion, and backups roll off within 14 days after that.
You promise that you have the right to submit your content and that it does not violate anyone's rights.
10. Our intellectual property
The software, the design, the brand "Athenion" and the way the service is put together belong to the operator or its licensors. We give you a personal, non-transferable right to use the service. You may not copy, sell or reverse-engineer it, except where the law allows. AI-generated lessons and notes shown to you can be used by you for your own learning and your own non-commercial use.
11. Availability and changes to the service
We aim to keep Athenion available but do not guarantee it, especially during the beta. We may change or discontinue features. If we discontinue the whole service, we will give you reasonable notice and a chance to export your notes, and refund any prepaid unused period if payments exist.
We will notify you by email or in the app at least 15 days before material changes to these terms take effect. For changes that affect price, we will notify you before your next charge. If you do not agree, you can cancel and delete your account.
12. Suspension and termination
You can stop using Athenion and delete your account at any time.
We may suspend or end your access if you seriously or repeatedly break these terms, put the service or others at risk, or if the law requires it. When reasonable, we will warn you first and let you export your notes. If we end a paid subscription without your fault, we will refund the unused part.
13. Disclaimers and limitation of liability
The service is provided "as is" and "as available", especially during the beta. To the extent the law allows, we do not guarantee that it will be uninterrupted, error-free, or that AI output will be accurate or fit for a particular purpose.
To the extent the law allows, our total liability to you for claims related to the service is limited to the amounts you paid us in the 12 months before the event that gave rise to the claim.
Nothing in these terms limits liability that cannot be limited by law, or your mandatory rights as a consumer, including those in your country of residence.
14. Governing law and disputes
These terms are governed by the laws of Peru. Disputes will be handled by the courts of Lima, without prejudice to your mandatory consumer rights in your country, including the right to go to your local courts or consumer authorities, and to Indecopi in Peru.
